In this Gift Card Terms of Use (these Terms), 'we', 'us', 'our' or ‘WeOz’ means WeOz Pty Ltd (ACN 644 679 238). These Terms apply to all WeOz gift cards (Gift Card).
You agree to be bound by these Terms by purchasing, activating, using, or attempting to use a Gift Card or by making a transaction enquiry or exercising any right to redeem value loaded on a Gift Card.
Capitalised terms not defined in these Terms have the meaning given to them in our Terms of Service.
1 Purchasing and redeeming a Gift Card
1.1 Online purchase
(a) You may purchase a Gift Card online on the WeOz Website.
(b) After you have made valid payment for the Gift Card, we will issue the Gift Card to your nominated email address.
(c) Gift Cards will be issued with a PIN number. In order for a Gift Card to be redeemed, you must provide the associated unique PIN number at time of redemption. If a PIN number cannot be provided, the Gift Card will not be able to be redeemed.
1.2 Expiry date
Gift Cards are valid for use within 3 years or 5 years (as specified in the email attaching the Gift Card) from the date of sale and are available for use 24 hours after purchase.
1.3 Redeeming a Gift Card
(a) Subject to the amount of the Gift Card, you may use the Gift Card for multiple Travel Products. Gift Cards may be redeemed in whole or part during the validity period. Where used in part, no change will be given. Any unused balance may be used against future purchases, but will not be refunded or credited when the Gift Card expires.
(b) Multiple gift cards may be redeemed for a single booking for all Travel Products that are available on the WeOz Website.
(c) Gift Cards may only be applied up to the maximum value loaded onto the Gift Card which is unspent at the time of use. Where the cost of purchase exceeds the available balance of the Gift Card, the excess amount must be paid by another payment method.
(d) Gift Cards may not be redeemed or exchanged for cash, gift cards, traveller’s cheques, cash passports or any other form of currency.
1.4 No reloading
You cannot subsequently add or load value to your Gift Card after the Gift Card has been purchased.
1.5 No refund
Subject to your rights under the Australian Consumer Law, Gift Cards are non-refundable. If a refund is necessary in connection with a booking made using a Gift Card (for instance, where refunds may be required in accordance with Terms of Service) funds will be refunded to the booking contact who made the relevant booking against which the Gift Card was redeemed.
1.6 Your obligations
You are responsible for the use and security of your Gift Card and PIN number. Subject to clause 3.1(b), lost or stolen Gift Cards may not be replaced or refunded. Lost or stolen PIN numbers cannot be reissued or replaced. You are liable for all transactions on your Gift Card except those caused by fraud or negligence by WeOz or its employees.
1.7 Personal information
Personal information collected in relation to your Gift Card will be handled in accordance with our Privacy Policy which is available here.
1.8 Balance enquiries
You can check your Gift Card transaction history and card balance through the WeOz website by following the instructions on the WeOz Website.
2 Conditions of using a Gift Card
2.1 No resale
Gift Cards may not, without the prior written consent of WeOz, be resold or offered for resale at a premium (including via online auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a Gift Card is sold or used in breach of this condition, WeOz may in its absolute and sole discretion cancel or render invalid the Gift Card without a refund and the Gift Cardholder may be refused redemption of the Gift Card. WeOz will take all reasonable steps to notify you of WeOz’s intention to cancel or render invalid a Gift Card within a reasonable time before cancelling or rendering invalid the Gift Card.
2.2 WeOz’s right to cancel
WeOZ may cancel or render invalid any Gift Card (including any available balance) which WeOz determines in its absolute and sole discretion was purchased at any time and in any way (including via online auction or other unauthorised resale sites) by fraudulent means. WeOz may cancel any bookings made using any fraudulent Gift Card which may include any non-refundable amounts. WeOz will not be responsible for any costs incurred by you if you purchase or attempt to redeem any fraudulent Gift Card. You acknowledge and agree that you will not be entitled to redeem any available balance on any fraudulent Gift Card and that WeOz will not be obliged to hold such balance on file for you or otherwise redeem or exchange that Gift Card.
3 Lost and replacement Gift Cards
(a) You must treat your Gift Card like cash. If your Gift Card is lost or stolen, please contact us via the WeOz Website.
(b) If you request a replacement of a new Gift Card after your original Gift Card was lost or stolen, we will only issue a replacement Gift Card to you if:
(i) the Gift Card is still valid and has not been fully redeemed; and
(ii) you can provide evidence showing that you are the original recipient of the Gift Card and we have verified this information with the purchaser (if the purchaser and the recipient are different persons).
(c) We reserve the right to place a stop on your Gift Card if:
(i) you report that your Gift Card has been lost or stolen;
(ii) we believe (or reasonably suspect) that you have used (or will use) your Gift Card contrary to these Terms; or
(iii) we believe (or reasonably suspect) that there is an error with your Gift Card.
4 Liability
4.1 Your responsibility
You are responsible for the security, use and safety of your Gift Card. Please be careful of scams and note we do not take any responsibility where you give access to your Gift Card to a third party in a manner that is not in accordance with these terms and conditions.
4.2 Limitation of liability
(a) Without excluding, restricting or modifying the rights and remedies to which you may be entitled under the consumer guarantees provisions of the Australian Consumer Law (and any other non-excludable statutory right) our liability to you in all other cases will be limited to refund or reissue of your Gift Card up to the value of your purchase.
(b) We will not be liable to you for indirect and consequential loss arising from or connected to these terms and conditions or your Gift Card in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or wilful misconduct.
(c) Our liability to you for loss or damage of any kind arising out of or in connection with these terms and conditions or your Gift Card is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.
4.3 Governing law
The laws of Victoria, Australia apply to these Terms and any disputes arising in relation to them.
